Mobile App & Consumer Portal – Terms and Conditions of Use
1. INTRODUCTION
Welcome to Advanced Benefit Strategies, Inc. (“ABS,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the ABS Mobile App and Consumer Portal (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and all applicable laws. If you do not agree, do not use the Services.
2. ABOUT ABS
ABS is a Connecticut-based Third-Party Administrator (TPA) that provides benefit administration services for employers.
The Services ABS provides allow participants to securely access balances, submit claims, upload documentation, view plan information, and manage reimbursements.
ABS provides the Services as an administrative convenience only and does not guarantee reimbursement eligibility, payment approval, or tax outcomes.
3. LICENSE AND OWNERSHIP
ABS grants you a limited, non-exclusive, non-transferable, revocable license to use the App and Portal for personal, lawful purposes related to your benefits. All software, data, and content within the Services are owned by ABS or its licensors and protected by U.S. copyright and trademark laws.
You may not:
- Copy, modify, distribute, or reverse-engineer any part of the Services;
- Use the Services for commercial purposes or on behalf of others; or
- Access data not intended for your use.
ABS reserves all rights not expressly granted.
4. PRIVACY AND SECURITY
ABS protects your personal and benefit data in accordance with applicable federal and state laws, including:
- HIPAA (45 C.F.R. §§ 160 & 164)
- HITECH Act (42 U.S.C. §§ 17931–17939)
- Connecticut Data Privacy Act (CTDPA)
All data is encrypted in transit and at rest. ABS also adheres to IRS confidentiality rules for benefit plan data.
Use of the Services is also governed by the ABS Privacy Policy, which explains data collection, use, and retention practices. ABS may disclose information to employers, insurance carriers, or payment processors as needed to administer your plan.
5. ACCOUNT SECURITY
You are solely responsible for safeguarding your login credentials, passwords, and multifactor authentication methods. Any activity conducted through your account is presumed authorized by you. ABS is not liable for losses caused by unauthorized access resulting from your failure to maintain security.
ABS may suspend or terminate access without notice if fraud, misuse, or suspicious activity is detected.
6. ACCEPTABLE USE
You agree not to:
- Use the Services for illegal, fraudulent, or abusive purposes;
- Upload malware or attempt to disrupt system performance;
- Access or use another person’s data or account;
- Interfere with or disable the Services; or
- Misrepresent your identity or eligibility.
Violations may result in suspension, permanent termination, and possible legal action.
7. DATA EXCHANGE AUTHORIZATION
By using the Services, you expressly authorize ABS to share and receive benefit-related information with your employer, insurer, or payment vendor as needed for plan administration, compliance, or verification purposes.
ABS may rely on data supplied by these third parties, and is not responsible for delays, errors, or omissions in that data.
8. DISCLAIMERS
The Services are provided “as is” and “as available.”
ABS makes no warranties, express or implied, regarding:
- Accuracy, completeness, or timeliness of data;
- Continuous or error-free operation; or
- Suitability of the Services for any particular purpose.
You acknowledge that electronic services may experience downtime, delays, or interruptions beyond ABS’s control.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
- ABS is not liable for any indirect, incidental, special, consequential, or punitive damages (including lost data, profits, or business opportunities).
- ABS’s total cumulative liability for any claim related to the Services shall not exceed $100 or the total amount paid by you to ABS in the preceding 12 months, whichever is greater.
Some jurisdictions may not allow these limits; in such cases, they apply to the maximum extent permitted by law.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless ABS, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including attorneys’ fees) arising out of:
- Your use or misuse of the Services;
- Your violation of these Terms; or
- Any unauthorized access or action using your account.
11. TERMINATION
You may stop using the Services at any time. ABS may suspend or terminate your access at its discretion, without notice, for any reason including:
- Violation of these Terms;
- System security or integrity concerns; or
- Employer plan termination.
All provisions concerning intellectual property, privacy, liability, and indemnification survive termination.
12. MODIFICATIONS
ABS may revise these Terms or update the Services at any time. Material changes will be communicated via email, App notice, or our website. Continued use after changes take effect constitutes your acceptance of the new Terms.
13. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Connecticut and applicable U.S. federal law.
All disputes shall be resolved by binding arbitration in Hartford County, Connecticut, on an individual basis.
You waive any right to participate in a class action or jury trial to the fullest extent permitted by law.
